The website located at www.activedonor.com (hereinafter “the Platform”, “Website”, or “Service”) is owned and operated by Active Apps (Pty) Ltd, a company operating in accordance with the Laws of the Republic of South Africa with company registration number 2017/198108/07 (hereinafter the “Company”, “we”, “us” or “our”). The Protection of Personal Information (POPI) Act requires us to inform our users how we use and share their Personal Information when they access and use our Service. Accordingly, this Privacy Policy informs you how we process your Personal Information, who we share it with, how we secure it and how you can exercise your rights. We are committed to ensuring the privacy of your Personal Information and will only use it in compliance with applicable law.

This Privacy Policy should be read in conjunction with our Terms of Use. By using our Service, you agree to the processing of your Personal Information in accordance with this Privacy Policy. If you do not agree with our privacy practices as outlined hereunder, please do not access the Service.

1. Definitions

Unless expressly defined otherwise in our Terms of Use, the words beginning with a capital letter in this Privacy Policy will have the meaning given to them in Section 1 of the Protection of Personal Information Act, 4 of 2013.

2. Scope of this privacy policy

This Privacy Policy applies to all Personal Information we process about you (‘user’, ‘subscriber’, ‘you’, or ‘your’) when you use our Service and any Donor Personal Information which we process on your behalf when you use our Service.

4. Our role

The Company acts as both a Responsible Party and an Operator under the POPI Act.

4.1. We act as a Responsible Party when we process the Personal Information of our users for account creation and management purposes, such as their full name, email address, subscription data and other similar information.

4.2. We act as an Operator when we process the Personal Information of Donors on behalf of our users, such as Donor name, contact details, identification/registration details, etc., which is required to enable our users to manage their database, issue 18A Income Tax Certificates to their Donors, and use our Services.

5. Types of information we process and how we receive it

We received the following information from the sources outlined hereunder:

Subscription data Your selected subscription plan, renewal date of your current plan and other information related to your subscription. We receive this information from you when you register an account.
Donor data Donor nature of the person (natural person, company, trust, etc.),

Full name of the Donor (if individual),

The legal name of the Donor (if an entity),

Contact person at the Donor organisation and their role and contact details (if the Donor is an entity),

Donor identification type and country of issue (in case of a natural person),

Identification or registration number of the Donor,

Tax reference number of the Donor (if available),

Contact number & email address of the Donor,

Trading name of the Donor (if different from the registered name).

We receive this information either from you when you manually add this information on the Platform or from the Donors when you send a Donor Update Form to the Donor through the Platform.
Support or query data Your full name, email address and the content of your request/query. We receive this information from you when you contact us by email or through our website.
Financial data Financial transaction information contained in your bank statements We receive this data from you when you upload your bank statements to the Platform to capture the receipt of donations from your bank statements.
Technical usage data This information relates to when and how you use our Service and includes the following:

Your Internet Protocol (IP) address, the device you use to access our Website, your web browser and version, the date and time of your visit, and other similar information through the use of cookies, web beacons and analytic tools.

We receive this information automatically when you access and use our Service.

6.  What do we use Personal Information for

6.1. We process your basic contact details and user account login credentials for the following purposes:

6.1.1. Creating/managing your user account;
6.1.2. Enabling you to access/use our Services;
6.1.3. Contacting you as and when needed.

6.2. We process your subscription data to provide you with our Service according to your selected plan;

6.3. We process the Donor data on your behalf when you use the Service to manage your Donor database and to issue Section 18A Income Tax Certificates to your Donors.

6.4. We process your Support and query data to understand your support request, respond to your query, contact you with requests for additional information if relevant and perform any other related actions.

6.5. We process your Financial data to enable you to use the Platform feature, which enables you to easily capture multiple transactions from your bank.

6.6. We process the Technical usage data for:

6.6.1. We may monitor access to our Service to ensure that only authorised users access the Service. In the event we detect any suspicious activity on an account, we may process this information to for reporting any security breaches;
6.6.2. Identify you as a unique user;
6.6.3. Improve your user experience – To this end, we make use of Optimizely to perform A/B tests on the Platform and improve our Service to you. Please note that Optimizely may process this information in the United States, where the data protection laws are less stringent than those in South Africa. 6.6.4. Evaluate our Website Usage – To this end, we also make use of Google Analytics; you can opt out of Google Analytics and/or review its privacy policy here. We use Analytics to gather non-personal information about our users to help us improve our web offering, performance and user experiences. Google Analytics uses cookies to perform its own services and may combine the information that it collects about you on our website with other information that they have collected. 6.6.5. We may also process this information to improve our understanding of how our users use our Service and to improve our Service.

7.1. When you sign up for our Service and submit your Personal Information through the Platform, you consent to the processing of your Personal Information in accordance with this Privacy Policy.

7.2. When you submit/upload any Donor’s Personal Information to the Platform, you act as the Responsible Party for Donor’s Personal Information, and we act as an Operator in processing such Personal Information on your behalf. You acknowledge and agree that you are responsible for obtaining all necessary consents from the Donors prior to uploading their Personal Information on the Platform. By uploading any Donor’s Personal Information on the Platform or by sending invitation links to Donors to complete the Donor Update Form, you guarantee that the Donor has given you consent to provide us with their Personal Information and that you are operating in compliance with the POPI Act.

8. Compliance with POPI Act

8.1. We apply the following principles in processing all Personal Information that you submit to us:

8.1.1. Unless we expressly obtain your consent, we will only use your Personal Information for purposes that are consistent and compatible with the purpose for which we collected it;

8.1.2. We will only process your Personal Information in a manner that is adequate, relevant and not excessive;

8.1.3. We will not disclose your Personal Information to any third party without your express consent except as provided in this Privacy Policy;

8.1.4. We will securely delete any Personal Information that we no longer need for the purpose for which we initially collected it;

8.1.5. We will be open with you and notify you as required by law as to why and how your Personal Information is collected;

8.1.6. We will safeguard your Personal Information in our possession using the current industry standards and best practices;

8.1.7. We will freely confirm what Personal Information we have about you and enable you to update/rectify your Personal Information. We also undertake not to keep your Personal Information for longer than legally required.

9. Disclosure of your Personal Information

We do not sell or rent your Personal Information. We may disclose your Personal Information as outlined hereunder:

9.1. Third-Party Service Providers

We may disclose your Personal Information to third-party service providers (“Service Providers”) who help us with the performance of our business operations, such as payment processing, emailing tools, analytics, marketing, customer support and other purposes for which your Personal Information is processed as described in this Privacy Policy.

9.2. Change of Ownership

If in the future, we enter into any sale/purchase negotiations or transactions with another business, our users’ Personal Information may be disclosed to such other business as part of negotiations and due diligence. If any commercial transaction results in a change in ownership of the Company, the Personal Information we process may be transferred to the new entity as part of the commercial transaction. Please note that in the aforementioned scenarios, your Personal Information will continue to be governed by this Privacy Policy, except in cases where you expressly consent otherwise.

9.3. Lawful requests

We may disclose your Personal Information if we receive a lawful request from any law enforcement authorities or courts of law by a subpoena or court order. We may also disclose your Personal Information to protect our users and the general public or to enforce our agreement with you.

We use all reasonable and commercially viable steps to protect your Personal Information, such as: hosting the application in a secure environment, secure access to the Platform, and limiting the impact of any user on the application based on their assigned role, however as with any digital transmission of information, we are unable to offer any guarantees of its security. 11. Your Rights

You have the following rights relating to your Personal Information:

11.1. Right to access your Personal Information. You may request a copy of all the Personal Information that we have about you.

11.2. Right to edit your Personal Information or request deletion of your Personal Information. If the Personal Information that we hold is inaccurate, outdated, excessive, or incomplete, you may request us to rectify it or delete it.

11.3. Right to object to the processing of your Personal Information. In limited circumstances, you have the right to object to processing your Personal Information.

11.4. Right to object to direct marketing. You have the right to object to the processing of your Personal Information for direct marketing purposes. If you object, we will immediately stop processing your Personal Information for direct marketing.

12. Transfer of Personal Information

We process and store your Personal Information in South Africa, and we will not transfer your Personal Information outside of South Africa. In the event we make use of any service provider that requires us to transfer or store your Personal Information outside of South Africa, we will only transfer your Personal Information to such service provider pursuant to the appropriate data processing agreement that requires the service provider to offer a similar level of protection as required by POPI Act in South Africa.

15. Children’s Privacy

The Active Donor Platform is not addressed to anyone under the age of eighteen (18) (“Children”).

We do not aim our Services at children and/or knowingly collect any Personal Information from anyone under the age of 18 years. If you are the legal guardian(s) or parent(s) of a Child and you have a reasonable cause to believe that your child has provided us with his/her Personal Information, please contact us immediately, and we will remove such Personal Information from our database and servers immediately.

16. Amendments to this Privacy Policy

We may amend and update this Privacy Policy at any time at our sole discretion. In the event we modify this Privacy Policy, we will inform you by changing the last updated date on the top. This Policy sets out how we collect and use your personal information when you use our Platform. We will never use or share the information you entrust Us with, with anyone except as described hereunder.
Information Collection And Use
In order for us to deliver Services to you, we require you to provide us with certain personally identifiable information. We will use this information to authenticate your login credentials, authorize your access to the Platform and contact you. We will collect the following information from you: your full name, your email address and your Phone number that you voluntarily provide us (“Personal Information”). We will also hold some data on your behalf for your Donors to enable you to identify them and communicate with them (“Your Client’s Personal Information”).
We also collect log data when you visit our Platform. Log data is information that your browser sends whenever you visit our Platform, such as your computer’s Internet Protocol (“IP address”), your browser type or version, the pages you visit and data on the time, and date of your visit.
We retain the aforementioned information in order to deliver our Service to you and to enhance our User experience.
Please note that we neither collect, process nor retain any sensitive personal information as defined in section 26 of Act No 4 of 2013.
Third-Party Analytics
We also make use of Google Analytics and Clicky, to evaluate the usage of our website; you can opt out of Google Analytics and review its privacy policy here. We use Analytics to gather non-personal information about our users to help us improve our web offering, performance and user experiences. We may occasionally employ other third-party service providers to help us in facilitating our Service and to assist us with intelligent analysis of how our users interact with our Service.
